General terms of sale and delivery

1. General

The points listed below inform you about our conditions of sale.
As soon as an order has been received, it is considered binding.

2. Prize

The prices confirmed by us are as follows: For individual sales including 7.7% VAT / resale excluding VAT

3. Payment terms

30 days net
If the payment deadline is not met, 5% default interest will be charged

By accepting the general terms and conditions, the customer confirms that they know the price and the conditions of sale of the Caves du Château d’Auvernier.

4. Delivery

No compensation for delayed delivery can be claimed. The Caves du Château d’Auvernier also reserve the right to make partial deliveries in the event of a shortage of stocks or events of force majeure or other unforeseen events.

5. Risk

Every delivery is at the risk of the customer. Damage incurred during transport must be reported immediately to the transport company concerned.

6. Transport costs

The transport costs are borne by the customer.

7. Right of withdrawal

The customer may at any time and before receiving the bottles of wine exercise his right of withdrawal by e-mail or mail without giving reasons. If the right of withdrawal is exercised after the goods have already been sent, the customer will have to pay the delivery costs incurred by Caves du Château d'Auvernier. The goods must be returned, undamaged and complete, within 3 (three) days after receipt in the original packaging, undamaged, complete and reusable (including label), and with the delivery note.

If orders from Caves du Château d'Auvernier are returned, the customer is responsible for the cost of reshipment. This also applies to cancellations of orders that the customer has not yet received but that have already left the warehouses of Caves du Château d'Auvernier.

If the return is due to an error on the part of Caves du Château d'Auvernier, the amount debited or paid will be credited to the customer's bank account. The shipping costs related to the return of the goods will be credited in the form of a voucher. In other cases of returns, the refund will be made in the form of a voucher.

8. Defective products

The customer must check the delivery as soon as possible.

If the product delivered does not correspond to the product ordered, if the product is defective (in particular defective, corky taste, it being understood that the defect must not be attributable to the customer, e.g. storage, inappropriate conservation, ...) or if the delivery is incomplete, the customer must notify the Caves du Château d'Auvernier within 3 (three) working days following the discovery of the defect by e-mail, by mail or by telephone (032 731 21 15). In this case, the Caves du Château d'Auvernier will provide an equivalent product as a replacement, subject to availability, in particular due to the year of production, the delivery costs being borne by the Caves du Château d'Auvernier.

The customer must then return the product concerned to the following address Caves du Château d'Auvernier, Place des Epancheurs 6, 2012 Milvignes within 3 (three) working days from the announcement of the defect. He will receive the necessary instructions and assistance directly from Caves du Château d'Auvernier.

If a replacement delivery is not possible for reasons not attributable to Caves du Château d'Auvernier, the latter cannot be held responsible and is therefore under no obligation to compensate the customer.

9. Place of jurisdiction

Subject to mandatory provisions of the Federal Supreme Court Act, the parties declare that, in the event of a dispute, they will choose the Neuchâtel court responsible for the matter.

10. Applicable Law

These general terms and conditions of sale are regulated by Swiss legislation; Articles 184 to 215 of the Code of Obligations apply in addition.
